In the motion filed by her attorney, Jeffrey Neiman, and made public over the weekend, Erika accused Robinson's team of resorting to delay tactics to stall the proceedings before going on to invoke her right to a speedy trial as a victim under Utah law.

"The Utah Code affords victims of a crime 'the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant,'" Neiman wrote in the court document, per the New York Post.

He continued, "This Court is tasked with the critically important function of ensuring the Defendant has a fair trial, but this Court must also do so while balancing Mrs. Kirk's right to a speedy trial, and therefore this Notice invokes Mrs. Kirk's rights under applicable Utah Code."

"Nobody believed in the importance of the United States Constitution more than Charlie Kirk," Neiman added. "And although the United States Constitution guarantees criminal defendants many rights, it does not guarantee them the right to cause undue delay in the criminal justice process."

Erika's demands come as Robinson's defense team continues to push for the removal of the local prosecutor.

The defense alleged that there is a conflict of interest because the daughter of a deputy in the county attorney's office was present at the rally when Charlie was murdered.

Robinson is due back in court on February 3 for day two of the hearing, where he and his team are expected to continue arguing on the perceived conflict of interest.

About Erika's filing, Donna Rotunno, a Chicago-based attorney, felt the move was too early, but noted that it's a good way to put the judge on notice due to the nature of the case.

"I don't really think this applies, but it is a very good strategic move to put the judge on notice that everyone is watching," Rotunno told Fox News Digital.

While Charlie spoke to the crowd at the event, a sniper's bullet struck him in the neck, leading to a chaotic scene as people ran for cover.

Robinson has now been charged with aggravated murder, felony discharge of a firearm, and committing a violent offense in the presence of a child. He was also hit with two counts of obstruction of justice and two counts of witness tampering.

According to the New York Post, prosecutors shared they have completed 90% of the discovery process, including DNA evidence linking Robinson to the weapon found near the scene.

However, the 22-year-old alleged shooter has yet to enter a plea or face a preliminary hearing, a major legal step in Utah's process where the prosecutors try to convince the judge they have cause to file charges.
